Terms of Use

These terms apply to your use of the AI Calorie Counter iPhone app (its name on the App Store varies by country) and the AI Calorie Counter Pro subscription, provided by MIOZ ("we", "us"). The app is licensed to you under Apple's Standard Licensed Application End User License Agreement (EULA), together with these terms. If they conflict, these terms apply to the extent Apple's agreement allows. By using the app, you agree to these terms.

Adults only (18+)

You must be 18 or older to use AI Calorie Counter. When you confirm on the consent screen that you are 18 or older, you confirm that this is true. Don't let anyone under 18 use the app on your device.

Estimates only, not medical or nutrition advice

  • Calories, protein, fat, carbs, portions and the daily target shown in the app are estimates. Meal estimates are generated automatically by AI from your sentence or photo and can be wrong or incomplete. The daily target comes from a standard formula and is only a starting point.
  • The app is not medical, dietary or nutrition advice and does not diagnose, treat or prevent any condition. Don't use it to manage a medical condition or to check ingredients or allergens.
  • If you are pregnant or breastfeeding, have a medical condition, or have had an eating disorder, talk to a doctor or another qualified health professional before following a calorie target or changing how you eat.

AI features

To estimate a meal, the app sends your sentence or photo through our server to Anthropic's Claude, or to Google's Gemini if Claude is unavailable, and only after you agree on the consent screen. Our Privacy Policy explains what is sent and what is kept. Check the estimates that matter to you, for example against a package label, and correct them in the app.

AI Calorie Counter Pro subscription

  • After the onboarding demo, using the app requires AI Calorie Counter Pro, an auto-renewable subscription with a weekly or yearly period. The title, length and price of each plan are shown in the app before you buy, and prices may vary by country.
  • Some offers may include a trial period. Its length and the price billed after it are shown before you start. If you cancel at least 24 hours before the trial period ends, you are not charged. Any unused part of a trial period ends when you buy a subscription.
  • Payment is charged to your Apple Account when you confirm the purchase, or when a trial period ends.
  • Your subscription renews automatically at the same price and for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
  • You can manage or cancel your subscription at any time on your iPhone in Settings › Apple Account › Subscriptions, or in the app under Settings › Subscription › Manage subscription. Cancelling stops future renewals; you keep access until the end of the period you paid for. Deleting the app does not cancel the subscription.
  • Payments and refunds are handled by Apple under its policies. You can request a refund at reportaproblem.apple.com. We can't issue refunds ourselves.
  • To keep the service available for everyone, AI estimates are limited per day (currently 30 per subscriber per day). Logging a recent meal again, adding a meal by hand and changing counts don't count towards this limit.

Your content

You keep all rights to the sentences, photos and other content you add. You allow us to process them only as needed to produce your estimates, as described in the Privacy Policy. You are responsible for having the right to use the photos you add.

Acceptable use

Don't use AI Calorie Counter to break the law or to infringe anyone's rights. Don't send content that is unlawful, harmful or unrelated to logging food. Don't try to get around the subscription or the usage limits, overload or interfere with our server, or access it other than through the app. Don't copy, modify or reverse-engineer the app, except where the law allows it. We may stop providing estimates to an app identifier that misuses the service.

Availability and changes

Estimates need an internet connection and depend on our server and the AI providers, so they may sometimes be unavailable. We may update, change or discontinue features. We may update these terms; we will post the new version on this page with a new date, and continuing to use the app after an update means you accept it.

Disclaimer and limitation of liability

AI Calorie Counter is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. We don't guarantee that estimates are complete or without errors. To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for decisions you make based on the app's estimates, and our total liability for any claim is limited to the amount you paid for AI Calorie Counter Pro in the 12 months before the claim arose. These limits don't apply to damage caused by our intent or gross negligence, or where the law doesn't allow them. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

本規約は、MIOZ（以下「当方」）が提供するiPhoneアプリ「AI Calorie Counter」（App Storeでの表示名は国・地域によって異なります）と、サブスクリプション「AI Calorie Counter Pro」のご利用に適用されます。本アプリは、Appleの標準使用許諾契約（Licensed Application End User License Agreement、EULA）と本規約にもとづいて、使用が許諾されます。両者が矛盾する場合は、Appleの契約が認める範囲で本規約が優先します。本アプリを利用することで、本規約に同意したものとみなされます。

18歳以上の方に限ります

本アプリをご利用いただけるのは、18歳以上の方です。同意画面で18歳以上であることを確認することで、それが事実であることを表明していただきます。18歳未満の方に、お使いの端末で本アプリを使わせないでください。

推定値であり、医療・栄養上の助言ではありません

  • 本アプリに表示されるカロリー、たんぱく質・脂質・炭水化物、量、一日の目安は、すべて推定値（目安）です。食事の推定は、文や写真からAIが自動で作るもので、誤りや抜けが含まれることがあります。一日の目安は標準的な計算式によるもので、出発点にすぎません。
  • 本アプリは医療・食事・栄養に関する助言ではなく、病気の診断、治療、予防を行うものではありません。病気の管理や、原材料・アレルゲンの確認には使わないでください。
  • 妊娠中・授乳中の方、持病のある方、摂食障害の経験がある方は、カロリーの目安に従ったり食生活を変えたりする前に、医師などの専門家にご相談ください。

AI機能

食事を推定するため、本アプリは同意画面で同意をいただいた後に限り、文または写真を当方のサーバー経由でAnthropicのClaudeに送ります（Claudeが使えないときはGoogleのGemini）。送るものと保持されるものは、プライバシーポリシーでご説明しています。大切な数値は、パッケージの表示などと照らし合わせて確認し、アプリ内で修正してください。

サブスクリプション「AI Calorie Counter Pro」

  • オンボーディングのデモの後、本アプリのご利用にはAI Calorie Counter Pro（週額または年額の自動更新サブスクリプション）への登録が必要です。各プランの名称、期間、料金は購入前にアプリ内に表示され、料金は国・地域によって異なる場合があります。
  • お試し期間つきのプランが提供される場合があります。その期間と、終了後に請求される料金は、開始前に表示されます。お試し期間が終わる24時間前までに解約すれば、料金は請求されません。お試し期間中にサブスクリプションを購入した場合、残りのお試し期間はなくなります。
  • お支払いは、購入の確定時、またはお試し期間の終了時に、Apple アカウントに請求されます。
  • 現在の期間が終わる24時間前までに自動更新をオフにしない限り、サブスクリプションは同じ料金・同じ期間で自動的に更新され、期間が終わる前の24時間以内に、更新の料金がApple アカウントに請求されます。
  • 管理と解約は、iPhoneの 設定 › Apple アカウント › サブスクリプション、またはアプリの 設定 › サブスクリプション › サブスクリプションを管理 から、いつでも行えます。解約すると次回以降の更新が止まり、支払い済みの期間の終わりまでご利用いただけます。アプリを削除しても、サブスクリプションは解約されません。
  • お支払いと返金は、Appleがその規定に従って取り扱います。返金はreportaproblem.apple.comからお申し込みください。当方が直接返金することはできません。
  • サービスを安定して提供するため、AIによる推定の回数には1日あたりの上限があります（現在は、登録者1人につき1日30回）。最近の食事からの再記録、手での追加、個数の変更は、回数に含まれません。

お客さまのコンテンツ

お客さまが入力した文、写真などの権利は、お客さまに帰属します。当方は、プライバシーポリシーに記載のとおり、推定を行うために必要な範囲でのみ、それらを処理します。追加する写真を使う権利があることは、お客さまご自身の責任でご確認ください。

禁止事項

次の行為を禁止します。法令に違反したり他人の権利を侵害したりする目的で本アプリを使うこと。違法・有害な内容や、食事の記録と関係のない内容を送ること。サブスクリプションや回数の上限を回避しようとすること、当方のサーバーに過大な負荷をかけたり妨害したりすること、アプリ以外の方法でサーバーにアクセスすること。法令で認められる場合を除き、本アプリを複製・改変・リバースエンジニアリングすること。サービスを不正に利用するアプリ識別子には、推定の提供を停止することがあります。

提供の状況と変更

推定にはインターネット接続が必要で、当方のサーバーとAIの提供元に依存するため、使えない時間が生じることがあります。当方は機能を更新・変更・終了することがあります。本規約を変更する場合は、新しい日付とともにこのページに掲載します。変更の後もご利用を続けた場合は、変更後の規約に同意したものとみなされます。

免責と責任の制限

本アプリは、法令で認められる範囲で、現状のまま、いかなる保証もなく提供されます。推定が完全であることや、誤りがないことは保証しません。法令で認められる範囲で、当方は、間接的・付随的・結果的な損害や、本アプリの推定にもとづいてお客さまが行った判断について責任を負いません。また、当方の責任の総額は、請求の原因が生じる前の12か月間にお客さまがAI Calorie Counter Proに支払った金額を上限とします。ただし、当方の故意または重大な過失による損害、および法令（消費者契約法を含みます）がこれらの制限を認めない場合には、適用しません。放棄できない消費者保護法上の権利は、本規約によって制限されません。
